Here are my top Five commandments for successfully closing your short sale.
1. Have an experienced agent. There is nothing worse then using an agent who is too lazy or lacks to motivation to constantly follow up with the bank, their negotiators & their clients. Short sale agents must be extremely persistant, organized and skilled in order to get the job done. A short cut for making sure this happens is to use an agent with a track record (at least 10-20 successful short sales under their belt.)
2. Recruit an experienced negotiator. It is way too difficult for the typical realtor to do both the realtor work while doing the negotiations. When hiring a short sale negotiator, make sure that their services are free to you as the homeowner and that they too have a strong track record (at least 75-100 successful short sales under their belt). A successful short sale is all about the teamwork between the realtors, homeowners, negotiators, mortgage officers & escrow agents. Don’t let the realtor try to do “everything,” because that will lead to failure.
3. Don’t lag on your short sale package. lenders will find every single excuse to put off your file. By being overly-responsive with the lender, you’ll give them no excuse to delay your short sale.
4. Qualify your buyer. WIthout a buyer there is no sale, thus a short sale is contingent upon having a strong, qualified buyer on board. Make sure that the buyer knows about short sales and that they don’t expect to close within days of sending their offer.
5. Don’t bring up too often the topic of deficiency judgements. The key to releasing yourself from liabilities is to “sneak it in” rather then create a big arguement out of it. Make sure your state even allows deficiency judgements before trying to argue against it. You can also negotiate and release deficiency judgements after the short sale with an attorney or professional DJ negotiator.
